Illinois legalized recreational cannabis in 2020 but does not allow home cultivation for recreational users. Cannabis seeds in Illinois can be purchased, though only medical patients may legally grow at home.
Illinois became the first state to legalize recreational cannabis through the legislature (rather than ballot initiative) with the Cannabis Regulation and Tax Act, which took effect January 1, 2020. While adults 21+ can purchase and possess cannabis, home cultivation is only allowed for medical patients — recreational users cannot grow their own plants. Cannabis seeds in Illinois are in a gray area for most consumers. Medical patients can legally buy and germinate seeds for home cultivation (up to 5 plants). For everyone else, seeds can be purchased as collectible items but should not be germinated. If you buy marijuana seeds in Illinois, they are sold as novelty items unless you are a registered medical patient.
