1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", "your") and DSS Genetics ("DSS Genetics", "we", "us", "our"), governing your access to and use of the dssgenetics.com website and all related services, including the purchase of products offered thereon.

By accessing our website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not accept these Terms, you must immediately cease using our website and services.

We reserve the right to amend these Terms at any time. Any changes will be posted to this page with an updated revision date. Your continued use of the website following any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

2. Age Verification — 18+ Only

Our website and products are strictly intended for adults aged 18 years or older. By accessing dssgenetics.com and placing any order, you confirm and warrant that you are at least 18 years of age.

We reserve the right to request proof of age at any stage of the ordering process and to cancel any order where age verification cannot be satisfactorily confirmed. If we discover that an individual under the age of 18 has submitted an order, we will cancel the order and arrange a full refund immediately.

Parents and guardians are responsible for ensuring that minors do not access our website or attempt to place orders. DSS Genetics accepts no liability for any breach of this provision resulting from a minor misrepresenting their age.

3. Products & Legal Disclaimer

Cannabis seed genetics are preserved and sold as collector's items of botanical and scientific interest. The purchase of cannabis seeds is legal in many countries and jurisdictions, while germination, cultivation, and possession of cannabis plants may be subject to local laws and regulations.

It is your sole responsibility to ascertain and comply with all applicable local, national, and international laws and regulations regarding the purchase, possession, import, and use of cannabis seeds. DSS Genetics accepts no responsibility or liability for any breach of law resulting from a customer's use of our products in any jurisdiction.

By placing an order, you expressly confirm that the purchase and importation of cannabis seeds is legal in your country of residence and that you will not use them for any unlawful purpose. DSS Genetics reserves the right to decline any order that we believe may be destined for use in violation of applicable laws.

Product descriptions, photographs, and genetic information provided on our website are for informational and descriptive purposes only. All strain descriptions and anticipated characteristics are based on breeder information and are not guaranteed outcomes, as plant phenotypes are influenced by environmental conditions outside our control.

4. Ordering & Payment

All orders placed through dssgenetics.com constitute an offer to purchase products subject to these Terms. Submission of an order does not constitute acceptance; a binding contract between you and DSS Genetics is formed only upon our dispatch of an order confirmation email to you.

We reserve the right to refuse, cancel, or limit any order at our discretion, including orders that appear to be placed for resale, orders where fraud is suspected, or orders to jurisdictions where we are unable to ship safely and legally.

All prices displayed on our website are inclusive of applicable taxes where required and are shown in the currency indicated. We accept payment via major credit and debit cards, bank transfer, and other payment methods displayed at checkout. All payments are processed via secure, PCI-DSS compliant processors.

Payment must be received in full before orders are dispatched. In the event a payment is declined or a chargeback is raised without valid justification, we reserve the right to suspend your account and recover any costs incurred, including processing fees.

5. Shipping & Delivery

DSS Genetics ships to a wide range of countries worldwide. Availability of shipping to specific destinations is subject to change and may be restricted due to legal considerations, carrier limitations, or customs regulations. It is your responsibility to ensure that importing seeds to your destination country is lawful before placing an order.

All orders are dispatched in discreet, plain packaging with no external branding or product descriptions that would indicate the nature of the contents. This is a standard practice designed to ensure the privacy and security of our customers.

Estimated delivery timeframes are provided as a guide only and are not guaranteed. DSS Genetics accepts no liability for delays caused by postal services, customs processing, weather events, or other circumstances beyond our control. Once an order has been handed to the carrier, the risk of loss passes to you as the customer.

If your order is seized by customs authorities, we are unable to refund the cost of the seized products. We recommend customers in higher-risk jurisdictions consider our stealth shipping upgrades where available. Customers are solely responsible for any customs duties, import taxes, or fees levied by their local authorities.

6. Returns & Refunds

Due to the nature of cannabis seeds as a biological product, we are unable to accept returns of opened seed packs in the interest of product integrity and biosecurity. All sales of opened seed packs are final.

Unopened, sealed products may be returned within 14 days of receipt, provided they are in their original undamaged packaging. Return postage costs are the responsibility of the customer unless the return is due to a fault on our part.

We offer a Germination Guarantee on all seeds purchased from DSS Genetics. If seeds fail to germinate under our recommended conditions, we will offer a replacement. Full terms of our Germination Guarantee, including conditions for making a claim, are set out in our Refund & Returns Policy available at dssgenetics.com/refund. The Germination Guarantee does not apply where our recommended germination instructions have not been followed.

7. Intellectual Property

All content on the dssgenetics.com website — including but not limited to text, strain descriptions, product photography, graphics, logos, icons, video content, and the overall site design — is the intellectual property of DSS Genetics or its content suppliers and is protected by copyright, trademark, and other applicable intellectual property laws.

You may access and view website content for personal, non-commercial purposes only. You must not copy, reproduce, distribute, publish, display, transmit, modify, or create derivative works from any website content without our prior written permission.

Any unauthorised use of our intellectual property may constitute infringement and we reserve the right to pursue all available legal remedies in such circumstances.

8. Limitation of Liability

To the fullest extent permitted by applicable law, DSS Genetics, its directors, employees, affiliates, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or in connection with your use of our website or products, including but not limited to loss of profits, loss of data, loss of business opportunity, or any other commercial losses.

Our total aggregate liability to you for any direct losses arising from or in connection with these Terms shall not exceed the total amount paid by you for the specific order giving rise to the claim.

DSS Genetics shall not be liable for any legal consequences arising from a customer's decision to germinate or cultivate seeds in a jurisdiction where doing so is prohibited. The customer accepts full legal and personal responsibility for their own actions.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

9. Indemnification

You agree to indemnify, defend, and hold harmless DSS Genetics, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

(a) your use or misuse of our website or products, including any use of seeds in violation of applicable laws in your jurisdiction;

(b) your breach of these Terms or any applicable law, regulation, or third-party right;

(c) any misrepresentation made by you, including but not limited to your age, identity, or the legality of importing seeds to your destination.

This indemnification obligation shall survive the termination of your account and these Terms.

10. Force Majeure

DSS Genetics shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from events beyond our reasonable control, including but not limited to: natural disasters, pandemics, epidemics, government actions, trade embargoes, sanctions, postal or carrier strikes, armed conflict, terrorism, civil unrest, severe weather, power failures, internet or telecommunications failures, or other disruptions to critical infrastructure. In the event of such circumstances, our obligations will be suspended for the duration of the force majeure event, and delivery timeframes will be extended accordingly.

11. Dispute Resolution

In the event of any dispute arising from or in connection with these Terms or your use of our website, we encourage you to first contact us directly at legal@dssgenetics.com to seek an informal resolution. We are committed to resolving disputes fairly and promptly.

If a dispute cannot be resolved informally within 30 days, both parties agree to attempt resolution through mediation before commencing any court proceedings. The mediation shall be conducted in the Netherlands in accordance with the mediation rules of the Netherlands Mediation Institute (NMI) or a mutually agreed alternative.

If you are a consumer resident in the European Union, you may also submit a complaint through the European Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. This does not affect your right to bring proceedings in the courts of your country of residence if applicable consumer protection laws so require.

12. Governing Law & Severability

These Terms of Service and any dispute or claim arising from or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

You agree that the courts of the Netherlands shall have exclusive jurisdiction to settle any dispute or claim arising from or in connection with these Terms, unless local mandatory consumer protection laws require otherwise. If you are a consumer resident within the European Union, you may also benefit from mandatory provisions of the consumer protection laws of your country of residence.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

13. Changes to These Terms

DSS Genetics reserves the right to revise and update these Terms of Service at any time. Changes will be effective immediately upon posting to this page with a revised "Last updated" date. For material changes, we may notify registered account holders via email.

Your continued use of our website or placement of orders following any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you should discontinue use of our website.
